Placing Orders for Products

By placing an order for products through Every Woman is Worthy website, you warrant that you are legally capable of entering into binding contracts.

Your Information

If you wish to place an order for products available on Every Woman is Worthy website, you may be asked to supply certain information relevant to your order including, without limitation:

By submitting such information, you grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of your order.

Order Cancellation/Refund Policy

Since our products are made to order and our manufacturing partner cannot restock them, we address returns on a case-by-case basis within 30 days after the product has been received. In cases where the product(s) received are misprinted/defective/damaged please see below:

Any claims for misprinted/damaged/defective items must be submitted within 30 days after the product has been received. Such claims must be submitted via email to contact@everywomanisworthy.com for consideration with photos of the misprint/damage/defect.

For packages lost in transit, all claims must be submitted no later than 30 days after the estimated delivery date. Claims deemed an error on our part are covered at our expense.

If customers notice an issue with the product(s) or anything else on the order, please submit a problem report by first reaching out to contact@everywomanisworthy.com.  Please note that if you are ordering multiple items at once that they may arrive in separate shipments.

The return address is set by default to one of our manufacturer’s facilities. We will do our best to inform customers of returned shipments as promptly as possible when our partners receive a returned shipment. Unclaimed returns get donated to charity after 30 days.

If the customer provides an address that is considered insufficient by the courier, the shipment will be returned to our partner’s facility. The customer will be liable for reshipment costs once we have confirmed an updated address (if and as applicable).

Shipments that go unclaimed are returned to our partner’s facility and the customer will be liable for the cost of a reshipment (if and as applicable).

Payments

Payment can be made through various payment methods we have available, such as Visa, MasterCard, Affinity Card, American Express cards or online payment methods (Google Pay or Apple Pay, for example).

Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, we will not be liable for any delay or non-delivery of your order.

Promotions

Any Promotions made available through Every Woman is Worthy website may be governed by rules that are separate from these Terms.

If you participate in any Promotions, please review the applicable rules as well as our privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

Intellectual Property

Arbitration

In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Every Woman is Worthy agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

Termination/Access Restriction

Every Woman is Worthy reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the Commonwealth of Virginia and you hereby consent to the exclusive jurisdiction and venue of courts in Virginia in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Every Woman is Worthy as a result of this agreement or use of the Site. Every Woman is Worthy’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Every Woman is Worthy’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Every Woman is Worthy with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Every Woman is Worthy with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Every Woman is Worthy with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

Changes to These Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
